Does my Australian super affect my US Social Security?

No, not for any benefit payable from January 2024 onwards. The rule that used to cut US Social Security for people with a pension from work outside the US system, the Windfall Elimination Provision, was repealed by the Social Security Fairness Act, signed on 5 January 2025 and reaching back to benefits payable from January 2024. Separately, the US and Australia have a social security agreement, but superannuation is not one of the Australian benefits it covers. What it can do is help you qualify for a US benefit using time in Australia, once you have at least six US quarters of coverage.

Could Australian super ever have reduced US Social Security?

Under the old rules it was possible. The Windfall Elimination Provision reduced US Social Security for people who also received a pension from work that did not pay into the US system. The Social Security Administration describes the provisions it has now repealed as ones "which could reduce Social Security benefits when someone received a pension based on work that was not covered by Social Security."

Whether a particular Australian super payment was caught by that rule was its own question. It no longer needs answering, because the rule has gone.

When did that change?

On 5 January 2025, when H.R. 82, the Social Security Fairness Act of 2023, was signed. The Administration's bulletin states that "the law repeals the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) provision."

It applies to benefits payable for months after December 2023. In the bulletin's words, the provisions "continue to apply to benefits payable for months before January 2024."

So for any US Social Security payable from January 2024 onwards, an Australian super balance or income stream does not reduce it.

What if my benefit was already being reduced?

The Administration says it will add the withheld amount back to your monthly payment and repay what was withheld from January 2024. If you have not yet claimed, the reduction simply never applies.

Does the US and Australia agreement cover super?

No. The two countries have a social security agreement, and Australia's Department of Social Services lists the Australian benefits it covers: the Age Pension, the Disability Support Pension for the severely disabled, pensions payable to widowed persons, and Carer Payment for people caring for a partner on one of those payments.

Superannuation is not on that list. Every Australian payment it covers is a government payment.

So what can the agreement do for me?

Help you qualify for a US benefit if your US record falls short. On the US side it covers retirement, disability and survivor benefits.

There is a floor. The Department of Social Services notes that "a person must have a minimum of 6 quarters of coverage before they can use the Agreement to qualify for US benefits." Below that, the agreement cannot help you get there.

What this guide does not tell you

It does not tell you whether you qualify for US Social Security, how much you would receive, or how a benefit worked out under the agreement is calculated.

It also leaves alone how Australian super is taxed in the United States; how US Social Security is treated by Australia's means test for the Age Pension; and the reverse question of whether US Social Security affects Australian payments.
